These Terms of Service ("Terms") govern your use of the albadigi.com platform and related services provided by Alba Digital Development LLC ("AlbaDigi", "we", "us", or "our"). By accessing or using our platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using any part of our platform, you confirm that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and agree to comply with these Terms. If you are using the platform on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. Description of Service

AlbaDigi is a multi-tool business platform that provides:

  • Invoice generation and payment tracking
  • Appointment booking and scheduling
  • Digital business cards (LixCard) with NFC support
  • Landing page builder
  • QR code generator with analytics
  • Social media design tools
  • Brochure and flyer studio
  • Point of sale, inventory, and other business modules
  • AI-powered business assistant

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

3. Account Registration

You sign in using your Google account via OAuth 2.0. You are responsible for:

  • Maintaining the security of your Google account
  • All activity that occurs under your account
  • Ensuring the information in your account is accurate and up to date
  • Notifying us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

4. Subscription & Payments

4.1 Pricing

Individual modules are available on a monthly subscription basis. Prices are displayed at the time of purchase and may be updated with 30 days' notice. All prices are in US Dollars (USD).

4.2 Billing

Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. You can cancel at any time from your account settings.

4.3 Refunds

Subscriptions can be cancelled at any time. You will retain access until the end of your current billing period. We do not provide prorated refunds for partial months. Physical NFC card purchases (LixCard and LixCard Custom) are covered by our LixCard Return & Replacement Policy.

4.4 Booking Credits

If you use the Appointment Booking module, client credit packs purchased are non-refundable once used. Unused credits may be refunded subject to the module's refund policy and expiration dates.

5. Free Trials

Some modules offer a free trial period (typically 14 days). During the trial, you get full access to the module's features. At the end of the trial:

  • You will need to subscribe to continue using the module
  • Your data will be preserved and accessible once you subscribe
  • No charge is made unless you explicitly subscribe

6. Acceptable Use

You agree not to use the platform to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Send spam, phishing, or unsolicited communications
  • Upload malicious code, viruses, or harmful content
  • Attempt to access other users' data or accounts
  • Overload, disrupt, or interfere with the platform's infrastructure
  • Use AI features to generate illegal, harmful, or deceptive content
  • Resell or redistribute the platform without authorization
  • Scrape, crawl, or harvest data from the platform

We reserve the right to suspend or terminate accounts that violate this policy without notice.

7. Intellectual Property

The AlbaDigi platform, including its design, code, branding, logos, and documentation, is the intellectual property of Alba Digital Development LLC and is protected by copyright and trademark laws. You may not copy, modify, or distribute any part of the platform without our written consent.

8. Your Content

You retain ownership of all content you create on the platform (invoices, cards, landing pages, etc.). By using the platform, you grant us a limited license to store, process, and display your content solely to provide the service. We will not use your content for any other purpose.

You are responsible for ensuring that your content does not violate any laws or third-party rights. We may remove content that violates these Terms or applicable law.

AI and search engines. Your published content is public: search engines may index it and AI assistants may quote it when answering questions. We do not allow your content to be used for training AI models, and we declare that restriction to crawlers on your behalf — unless you choose otherwise.

For a LixCard, the person the card belongs to can allow AI training for that card from the card editor. This is off by default, it is never enabled on your behalf, and you can switch it off at any time. Switching it off stops future use, but content that has already been incorporated into a trained model cannot be withdrawn from it. On LixCard Business team cards, only the team member linked to the card can give this permission — not the company that manages it.

9. Third-Party Integrations

Our platform integrates with third-party services including Google (OAuth, Gmail, Places), Stripe, and others. Your use of these integrations is subject to the respective third-party terms of service:

We are not responsible for the availability, accuracy, or practices of third-party services.

10. Limitation of Liability

To the maximum extent permitted by law:

  • AlbaDigi is provided "as is" without warranties of any kind, express or implied
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim
  • We are not responsible for losses resulting from third-party service outages, data breaches at third-party providers, or force majeure events

11. Termination

You may delete your account at any time from your account settings. Upon termination:

  • Active subscriptions will be cancelled (no prorated refund)
  • Your data will be deleted within 30 days per our Privacy Policy
  • Public pages (landing pages, digital cards, QR codes) will stop working immediately

We may terminate or suspend your account if you violate these Terms, with or without notice depending on the severity of the violation.

12. Disclaimers

  • AI Features: Our AI assistant and AI-powered tools provide suggestions and generated content for informational purposes. They do not constitute professional advice (legal, medical, financial, or otherwise). You are responsible for reviewing and verifying all AI-generated content.
  • Uptime: While we strive for high availability, we do not guarantee uninterrupted service. Scheduled maintenance and occasional downtime may occur.
  • Data Accuracy: We rely on third-party APIs (Google Places, Stripe, etc.) for certain data. We do not guarantee the accuracy of data provided by these services.

13. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Miami-Dade County, Florida.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Effective" date. Your continued use of the platform after changes constitutes acceptance of the updated Terms. If you disagree with any changes, you may close your account.
